GO GREEN INSTANT SAVINGS Terms and Conditions
Eligibility to claim the GO GREEN INSTANT SAVINGS offer ("Offer") is limited to Customers purchasing eligible Dacor appliances ("Eligible Appliances") from any authorized Dacor retailer throughout the United States and Canada during the Promotional Period (January 1, 2013 through June 30, 2013). All Eligible Appliances must be purchased in a single transaction at UMRP before tax during the Promotional Period. This Promotion is offered through participating Dacor dealers ("Dealer") only. Customer must take delivery of Eligible Appliances no later than July 31, 2013. Offer good on sales of new, boxed Dacor appliances only. Standard warranty applies. Offer is valid in conjunction with Dacor's 3 For Free Warranty promotion. Offer void where prohibited. Offer cannot be exchanged for cash nor ownership transferred. Customer is responsible for determining, recording, and paying all federal, state and local taxes related to package purchase. By participating in this offer, each Customer agrees that any and all disputes which cannot be resolved between the parties, claims and causes of action arising out of or connected with this promotion, or any Instant Savings awarded, shall be resolved individually, without resort to any form of class action, exclusively by arbritration pursuant to the commercial arbitration rules of the American Arbitration Association, then effective. Further, in any such dispute, under no circumstances will Customer be permitted to obtain awards for, and Customer hereby waives all rights to claim punitive, incidental or consequential damages, or any other damages, including attorneys' fees, and Customer further waives all rights to have damages multiplied or increased. All issues and questions concerning the construction, validity, interpretation and enforceability of these Terms and Conditions, or the rights and obligations of Customer and Dacor in connection with this Offer, shall be governed by and construed in accordance with the laws of the Sate of California, U.S.A., without giving effect to the conflict of laws or rules thereof, and all proceedings shall take place in that State in the City and County of Los Angeles. Fraudulent submissions of multiple requests could result in federal prosecution under the U.S. Mail Fraud Statute (18 USC Section 1341 and 1342). The customer information provided to Dacor by the Dealer Sales Associate will be handled by Dacor according to Dacor's Privacy Policy. Dacor collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, offer suppliers and as rquired, to United States and Canadian regulatory authorities. The Dealer's claim submission is conditional upon providing this information. If the claimant does not mark the applicable box, Dacor may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Claimants should direct any requests to access, update or correct information to Dacor. All claims become the property of Dacor.
